Currently, under Georgia law, the statute of limitations is two years from the date of accident. That is generally speaking, recently the Georgia Supreme Court has ruled that the statute of limitations can be tolled or extended in cases where the at fault driver is issued a traffic citation, the statue can be tolled until resolution of the criminal charges.

This can extend the statute of limitations on any case where a traffic citation or criminal charge has been issued.

Depending upon the criminal charges the statute of limitations can run past two years and theoretically as long as it takes the criminal courts to resolve the pending criminal charges.
